1. Agreement to these terms

These Terms of Service (“Terms”) are an agreement between you and [Business legal name], doing business as Cleavera (“Cleavera,” “we,” “us” or “our”). They apply when you visit this website (the “Site”), sign up for emails or promotions, or buy our products. By using the Site or placing an order, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the Site.

2. Eligibility

You must be at least 18 years old, and able to enter into a binding contract, to buy from us or take part in our promotions. Our products are intended for adults only. We currently sell and ship only to addresses in the United States.

3. Product information and supplement disclaimer

Cleavera Lymphatic Drainage Drops are a dietary supplement. We work to describe our products accurately, including ingredients, serving size and directions. Product packaging may be updated from time to time, so always read the label on the product you receive before use; if it differs from the Site, follow the label.

These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease.

Information on the Site, in our emails and from our team is for general educational purposes only. It is not medical advice and is not a substitute for advice from your doctor or another qualified healthcare professional. Consult your healthcare professional before use if you are pregnant or nursing, take any medication (including blood thinners or hormone therapy), have a hormone-sensitive or bleeding condition, or are scheduled for surgery. Do not exceed the recommended serving. Stop use if you experience nausea or digestive upset. Keep out of reach of children. Individual results vary.

4. Orders, pricing and errors

Prices. All prices are in US dollars. Applicable sales tax and shipping charges are shown at checkout before you pay. We may change prices at any time, but changes won’t affect orders we’ve already accepted. Subscription price changes are covered in section 6.
Order acceptance. Your order is an offer to buy. We accept it when we ship it. We may refuse or cancel an order, or limit quantities, for example if a product is unavailable, we suspect fraud or resale, or there’s an error. If we cancel an order after you’ve paid, we’ll refund you in full.
Errors. We try to keep everything on the Site accurate, but mistakes happen. If a product is listed at the wrong price or with incorrect information, we may correct the error and cancel any affected orders, even after you’ve received an order confirmation. We’ll let you know and refund any amount charged.
Payment. You confirm that you’re authorized to use the payment method you provide. Payments are processed by our third-party payment processor.

5. Promotions and discount codes

General rules for all codes

Only one discount code can be used per order, and codes can’t be combined with each other.
Discount codes apply to one-time purchases only. They can’t be used on subscriptions, which already include 25% off.
Codes have no cash value, can’t be exchanged for cash or credit, can’t be applied to past orders, and may not be sold, transferred or shared publicly.
Discounts apply to product prices, not to taxes or shipping. Free-shipping eligibility is based on your order total after discounts.
We may refuse, cancel or adjust any order where a code was used in violation of these rules, and we may change or end a promotion at any time without affecting codes already validly issued.
Promotions are void where prohibited by law.

Spin-to-win terms

How it works. New customers can enter an email address and spin the reel once to receive a discount code. Every spin wins a code for 10%, 15%, 20% or 25% off. There are no cash prizes or merchandise prizes.
Odds. Each spin is weighted as follows: 10% off (about 50% of spins), 15% off (about 30%), 20% off (about 15%) and 25% off (about 5%).
One per customer. Limit one spin and one spin-to-win code per person, household, email address and payment method. Creating extra email addresses to spin again isn’t allowed, and extra codes may be cancelled.
First order only. Codes are valid only on your first one-time order with Cleavera.
7-day validity. Codes expire 7 days after they’re issued.
No combining. Spin-to-win codes can’t be combined with any other discount code, including email welcome offers, and can’t be used on subscriptions.
No cash value. Codes have no cash value and can’t be redeemed for cash or store credit.
Email consent. By entering your email, you agree to receive marketing emails from Cleavera. You can unsubscribe anytime; you don’t need to stay subscribed to use your code.

Email welcome offer

When you join our email list, we may send a welcome code for a discount on your first one-time order. It follows the general rules above and can’t be combined with a spin-to-win code.

6. Subscriptions and automatic renewal

Please read this section carefully. Subscribe & Save is optional. One-time purchase is selected by default, and you’re only subscribed if you choose it yourself. When you choose Subscribe & Save, you agree that your subscription will renew automatically and that we will charge your payment method on each renewal date, until you cancel.

Price. You pay the subscription price shown at checkout, which is 25% off our one-time price for the bundle you choose, plus applicable sales tax. Subscription orders always ship free. Current subscription prices are listed below.
Frequency. Your subscription ships and renews on a schedule that matches your bundle: 1 bottle every 30 days, 2 bottles every 60 days, 3 bottles every 90 days or 6 bottles every 180 days.
When you’re charged. We charge your payment method when you place your first subscription order, then on each renewal date for the next delivery.
Renewal reminders. Before every renewal charge, we’ll email you a reminder with the date, the amount and a link to skip, pause or cancel.
How to cancel. You can skip, pause or cancel online anytime, or by emailing hello@cleavera.com. There are no cancellation fees and no minimum number of orders.
Cancel before your next charge date. To avoid being charged for your next delivery, cancel or skip before your next charge date. If you cancel after a renewal has been charged, cancellation applies from the following delivery; contact us and we’ll do our best to help with the order that’s already been charged.
Confirmation. After you subscribe, we’ll email you a confirmation that includes these terms and how to cancel. We’ll also confirm by email when you cancel.
Price changes. If we change the price of your subscription, we’ll email you before the new price takes effect, and you can cancel before your next charge.
Failed payments. If a renewal payment fails, we may retry it or pause your subscription until your payment details are updated.

7. Shipping, returns and our guarantee

Shipping rates, delivery times, lost or damaged packages and our 60-day money-back guarantee on first orders are described in our Shipping & Returns policy, which is part of these Terms. Risk of loss passes to you when your order is delivered to the shipping address you provided.

8. Using our Site

You agree to use the Site only for lawful purposes. Please don’t:

use the Site to commit fraud, or abuse promotions or discount codes;
try to access parts of the Site or our systems you’re not authorized to access;
interfere with the Site’s security or operation, including through bots, scrapers or malicious code;
copy or resell our products or content for commercial purposes without our written permission.

If you send us feedback or ideas, we may use them without any obligation to you. The Site may link to third-party websites, such as FDA resources. We aren’t responsible for their content or practices.

9. Intellectual property

The Site and its content, including text, images, graphics, logos, product names and the Cleavera name, are owned by or licensed to Cleavera and protected by copyright, trademark and other laws. You may view and print pages for your personal, non-commercial use. Any other use requires our written permission.

10. Disclaimer of warranties

We stand behind our products as described in our money-back guarantee. Beyond that, and to the fullest extent permitted by law, the Site and our products are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We don’t promise any particular result from using our products, and individual results vary. Some states don’t allow certain warranty disclaimers, so some of these may not apply to you.

11. Limitation of liability

To the fullest extent permitted by law, Cleavera and its owners, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from your use of the Site or our products. Our total liability for any claim relating to the Site or a product will not exceed the amount you paid for that product. Some states don’t allow these limitations, so they may not apply to you. Nothing in these Terms limits liability that can’t be limited by law.

12. Indemnification

You agree to indemnify and hold harmless Cleavera from claims, losses and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site or our products or your violation of these Terms, to the extent permitted by law.

13. Governing law and disputes

These Terms are governed by the laws of the State of [State], without regard to its conflict-of-law rules. Before filing a claim, please contact us at hello@cleavera.com so we can try to resolve the issue informally. Any dispute that can’t be resolved informally will be brought in the state or federal courts located in [County], [State], and you and Cleavera consent to their jurisdiction. Either of us may bring an individual claim in small claims court instead.

14. Changes to these terms

We may update these Terms from time to time. When we do, we’ll change the “Last updated” date at the top of this page, and we’ll notify you by email or on the Site about significant changes. Changes apply to orders placed and Site use after they’re posted. Changes that affect your active subscription will be emailed to you before they take effect.

15. General

These Terms, together with our Privacy Policy and Shipping & Returns policy, are the entire agreement between you and Cleavera about the Site and your purchases. If any part of these Terms is found unenforceable, the rest stays in effect. If we don’t enforce a provision right away, we haven’t waived it. You may not transfer your rights under these Terms; we may transfer ours, for example as part of a sale of our business.
